TRUSTS AND ESTATE LITIGATION

Trust and estate disputes often involve the validity of the will or trust, the capacity of the decedent at the time the will or trust was signed, disagreements regarding the management of the trust or estate assets, interpretation of the will or trust, and breach of a fiduciary's duties.  Pastor Law Group, PC regularly handles all aspects of trust and estate litigation including discovery and trials. 

PROBATE LITIGATION

After a loved one passes away conflict may arise regarding various aspects of the probate process. Potential areas of conflict may include who will be appointed to administer the decedent's estate, management of the decedent's assets, interpretation of the decedent's estate plan, and the eventual distribution of the decedent's estate.  We regularly assist in all aspects of probate litigation.

APPEALS

In probate court, it is unlikely that every party will be satisfied with the outcome of a case. However, while it is rare, if you believe a mistake was made during the court proceedings that led to an imbalanced or incorrect ruling, requesting an appellate court to review the decision may be an option that’s available to you. If you act promptly and have an attorney with substantial appellate court experience by your side, you may be able to successfully appeal a probate court decision.

CONSERVATORSHIP

Nathan D. Pastor assists in all aspects of conservatorships including setting up conservatorships as well as managing the conservatorship after the conservatorship is established.  Nathan assists with marshaling assets, managing assets and completing all required court filings, including fiduciary accountings.  Nathan also regularly handles limited conservatorships for adults with disabilities and special needs.  

Conservatorship LITIGATION

Nathan D. Pastor is a member of the Court’s Conservatorship Panel of attorneys and regularly serves as court appointed counsel. Nathan has extensive experience handling conflict both before and after a conservatorship is established.  Sometimes conflict may arise regarding long-term care planning, asset protection, protection against financial exploitation, management of the elder's finances and/or who is to be appointed conservator.
